Can I ask where we stand in the case when Mychillybin has the licence to sell an image, but we as photographers want to also use the same image for fine art or personal purposes. For example, could I give an image to Mychillybin and also print/frame it for fine art purposes such as an exhibition. Potentially I could make money from sales, but under the genre of ART, not editorial or advertising. Where does this fit into our contract?

Hi Fatsprat

Good news, photographers can do both! You are able to include an image in your mychillybin portfolio and also use the same image for fine art purposes/exhibitions. You can also give the same image to your Grandma to hang on her wall.
You are unable, however, to provide an image to mychillybin and then the same image to another stock library.

In regards to your exhibition - tell us all about it!

Does this still apply to photos that you sell that are numbered, say 1 of 10 prints?

Hi Ana

If its for personal use, or an exhibition, that's fine. The only restriction is placing the same image into another stock library.

Ana, I think you may be referring to what's called a 'Limited Edition'? I would discuss this with your gallery. Purchasers of a Limited Edition print might not be too happy to find the same image on a stock site.

Hi, one thing I wanted to check, I do submit pictures to Flickr (with full copyright and block the ability to download my images), I assume as I am not using it to sell images it is Ok to can contiune to do this with some of the images I send to mychillybin, is this correct, just want to make sure I don't cause any issue by doing this. Thanks

Hi Maloe4,

We've checked out Flickr and even though you block the ability to download, the images can still be dragged off and used. This is one reason why mychillybin uses watermarks - to protect your images!

Our commitment to your customers is that all images are exclusive to mychillybin. Therefore, we ask that the same images are not placed on both. A possible solution to this would be any images you wish to sell, create a link from Flickr directly to your mychillybin portfolio.

Thanks Rosie, I will check out the link idea, short of that will remove them from Flickr, appreciate the reply and glad I asked now. Agree the watermarking is the best solution and even images I don't submit to sell will be watermarked from now I think. Cheers - Mark

OK, in case anyone else is interested looks like theres some commercial usege rules with Flickr regarding links and selling so no links going on and I have removed any affected images from it. Thanks again Rosie.

Note that whilst these images will be suitable for Editorial Use, some of these images are not able to be used for General purposes as they contain brands, people, etc without needed legal releases.

Except when the actual image is shown to be for Editorial Use Only, then it can also be used for the specified period in the sames way as the Enhanced Licence, as follows

(ii)   Items not for resale (e.g. ads, marketing materials, websites, social media posts, unpaid apps, posters, flyers, reports, ...)

(iii)   Items for resale (e.g. use of image on coasters, paid apps, screensavers, or printed map books, reports, magazine covers etc that are sold on websites or through shops ...)

Specified Period - images may not be used beyond the specified period, without a further licence of some type being obtained.

Select the Enhanced Licence for any of the following:
